Vishaka v. State of Rajasthan (1997) – Addressing Sexual Harassment at the Workplace

The Vishaka case was a groundbreaking judgment that brought attention to workplace sexual harassment in India. Before this ruling, there was no specific law addressing such harassment, leaving many women vulnerable and without recourse.
The Supreme Court recognized sexual harassment as a violation of fundamental rights to equality (Article 14) and dignity (Article 21). It issued binding guidelines requiring employers to establish complaint committees, conduct prompt inquiries, and protect complainants from victimization.
These Vishaka guidelines laid the groundwork for the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, the first comprehensive legislation on the subject. The judgment was a turning point in creating safer, more equitable workplaces.
